A Suffolk mother is reportedly planning to sue the county's police department over her son's death.
ABC 7 says Maria Busone will file a notice of claim against Suffolk and state police and the Town of Brookhaven fire marshal for not issuing an Amber Alert during her son's disappearance.
Her 2-year-old son Jovani Ligurgo was kidnapped and killed by his father in June in what officials are calling a murder-suicide.
An Amber Alert was never sent out.
At the time, police told told News 12 it wasn't warranted because the father did not have a criminal history.
