Prosecutors called the mother of a Glen Cove man accused of murder to the stand at a pretrial hearing Monday.
Evan Marshall's mom, Jacqueline, was subpoenaed to testify about where her son was on August 17, 2006 . That's the day her neighbor, Denise Fox, was murdered. In an attempt to evade the press, she wore a wig and a large hat to disguise her identity as she entered the courtroom.
"She felt very uncomfortable about being put in this particular situation, as one could imagine," Jacqueline Marshall's attorney, Paul Gianelli, said.
Jacqueline Marshall, who was granted immunity for her testimony, said her son called the night before to say he might come downstate to visit. She left the door to the basement, where he was to sleep, unlocked. However, she said she never checked to see if he had arrived during the night in question.
Evan Marshall, now 32, is accused of murdering and decapitating Fox. Police said parts of Fox's body were found in Jacqueline Marshall's basement and her head was found in the trunk of Evan Marshall's car.
Both of the Marshalls' attorneys objected to Jacqueline's testimony. Gianelli said the hearing is to decide whether Evan Marshall should be charged. The decision, Gianelli said, is based on evidence available at the time of the arrest. Because police didn't question the suspect's mother before his arrest, Gianelli said her testimony shouldn't be included in this hearing.
Last week, the director of SLS Health in Brewster, New York, testified that the suspect took a 3-day leave around August 17.
