The charges against a North Lindenhurst man accused of shaking his infant son to death have been upgraded Wednesday to second-degree murder.
Police arrested Joseph Perri, 24, for assault last month after he rushed his 4-month-old son Gabriel to Good Samaritan Hospital. Doctors say the boy was a victim of Shaken Baby Syndrome, and the baby later died. Police say Perri confessed to the crime. Perri?s attorney says his client did not intentionally hurt his son.
Meanwhile, a funeral cannot be held for Gabriel because the defense can legally ask for an independent autopsy. Perri is being held without bail until his trial.
