Police say Franklin Marquez Sarmiento was pulled over on Sunrise Highway in Islip around 3 a.m. Sunday after he was spotted swerving.
A 15-year-old, a 13-year-old and a 4-year-old were in the car at the time, according to authorities.
Marquez-Sarmiento is charged with aggravated DWI under Leandra’s Law.
