A former patient of the Plainview doctor accused of reusing syringes is considering legal action against the county, state and the doctor, her lawyer says.
Susan Lewis, a North Massapequa mother of four, tested positive for hepatitis C last month. She was Dr. Harvey Finkelstein?s patient from 2002 to 2004 after she hurt herself on the job and went on workers? compensation.
Lewis? lawyer, Andre Ferenzo, says his client is considering suing because she was never notified she may be at risk. Lewis says it was only when she saw Finkelstein on the news in the middle of the scandal that she found out she may be in trouble.
Ferenzo wonders if Finkelstein?s records for workers? comp patients were separate from the records for his personal patients. If so, he says, there could be thousands of other patients who may not know they are at risk.
Finkelstein has taken a leave of absence from North Shore Hospital in Plainview and New Island Hospital.
