A bodybuilder from Brooklyn was indicted Monday in Mineola for allegedly shooting his parents at their Hewlett Harbor home on Christmas Day.
Dino Tomasetti got in a dispute with his parents while attempting to get his now 2-year-old from his child's biological mother, according to police.
Police say Tomasetti, 29, then shot his 64-year-old mother, Vincenza Tomassetti, in the head and his 65-year-old father, Rocco Tomassetti, in the back and left wrist before hitting him in the head multiple times when he ran out of bullets.
Dino Tomasetti then fled in a Cadillac Escalade and was later found in New Jersey and brought back to Long Island.
The mother of the child and the 1-year-old were in the home at the time of the alleged attacks and were unharmed.
Both parents and the mother of his child were in court to support Dino Tomasetti, the lawyer says.
"His mom, his dad, the mother of his child were all here today in complete support of him as they have been since day one," says William Petrillo.
Petrillo says Dino Tomasetti didn't intend to do harm on the day of the incident.
Nassau County District Attorney Anne Donnelly says that the victims made remarkable strides in their recovery and are lucky to be alive.
Dino Tomasetti is facing two counts of attempted murder, assault in the first and second degree, criminal possession of a weapon and endangering the welfare of a child.
Temporary orders of protection for the child, the child's mother and Vincenza and Rocco Tomasetti remain in effect.
Dino Tomasetti pleaded not guilty. He was remanded and his bail remained the same.
He is due back in court on Feb. 23.
