A Sayville vape shop owner is suing over a Town of Islip zoning regulation that is forcing his business to move.
A May 2016 zoning change classified vape shops as adult-use businesses -- the same category used for strip clubs. And like strip clubs, vape shops cannot operate in a business district and instead must be located in an industrial area.
Blackwater Vapor owner Michael Shannon says his store opened before the change and it should be grandfathered in.
Shannon has filed a lawsuit againt the Town of Islip Zoning Board of Appeals.
Attorneys for the vape shop say there are stores across from Blackwater that sell booze and cigarettes and questions why they're not considered adult use.
Islip officials would not comment, citing pending litigation.
Shannon says he wants the town Zoning Board to amend its decision. He was given just over a year to move his store.
