A notice of claim has been filed against the Three Village Central School District after a student was allegedly choked out by a classmate.

According to the claim, the attack happened in March and was preceded by months of both verbal and physical bullying in gym class at Paul J. Gelinas Junior High School.

News 12 is told teachers and administrators were told of the problem but did nothing.

The district says it does not comment on pending litigation.
