A Mattituck man is facing upgraded charges in the hit-and-run crash that killed a father who was out for a jog.

An 11-count grand jury indictment was unsealed against 32-year-old Keith Clancy. Among the upgraded charges is aggravated vehicular homicide.

Police say Clancy fatally struck Michael McDermott as he was jogging on Lake Avenue in St. James last month.

According to Suffolk County District Attorney Tim Sini, a blood test taken approximately 3 1/2 hours after the crash revealed a high level of fentanyl in Clancy's blood. A search warrant executed on Clancy's vehicle resulted in the seizure of a glassine envelope of fentanyl.

Clancy’s license was revoked at the time following a previous DWI.

State Supreme Court Justice Fernando Camacho ordered Clancy held on bail of $250,000 cash or $500,000 bond. If convicted of the top count, he faces 8 1/3 to 25 years in prison.

His lawyer, Anthony LaPinta, made a statement upon leaving Central Islip court:

"Our path is clear. We need to investigate these facts. We need to understand exactly what happened here, how the accident happened, understand the prosecution's evidence, look at their expert reports and come to a determination whether these facts and evidence support these charges."

Clancy is due back in court on Sept. 10.
