Kyle Howell and his attorney have called for federal prosecutors to take over his police brutality case against Nassau Police Officer Vincent LoGiudice.

Howell was allegedly beaten by LoGiudice and his partner in Westbury during a traffic stop in April. The incident was caught on surveillance video.

Howell was originally arrested for assaulting the officers. Those charges were dropped when LoGiudice was charged with felony assault. The Nassau officer pleaded not guilty to those felony assault charges.

As News 12 has reported, Kyle Howell was accused of having both cocaine and marijuana in his car. He later admitted he lied to the media when he denied he had marijuana.

Howell's attorney Amy Marion and his parents say the Nassau District Attorney's Office failed to properly investigate the incident. She says a part of the surveillance camera footage shows LoGiudice planting evidence, possibly a bag of cocaine, on Howell.

Marion says that the video was never sent to the FBI to have it enhanced before presenting it to the grand jury. She doesn't just want the Nassau DA to appoint a special prosecutor. She sent a letter to the U.S. Attorney's Office, demanding a federal investigation.

A spokesman for the district attorney said in part, "These irresponsible and false allegations will not help seek justice in this case and there is no justification for a special prosecutor."

Officer LoGiudice's attorney William Petrillo says its "absurd" to suggest his client would plant evidence. He also says that "every action taken by the officer [was] reasonable and necessary under the circumstances."
