A Hicksville man is one step closer to a possible retrial on his felony drug conviction after a judge granted a hearing to determine if there was enough evidence to retry the case.
Khurram Shahzad, 27, was convicted of possession of cocaine in 2010. The now-shuttered Nassau County Crime Lab said a substance found in Shahzad's car was cocaine.
The lab was closed after a state audit showed it failed to properly test evidence, among other issues.
Shahzad, who is from Pakistan, only has a green card and is facing deportation if his felony conviction stands.
