A Levittown man serving a 25-year sentence for robbery may receive a new trial five years after his conviction.
John Daly has served six years for two robberies that occurred in 2001. Nancy Daly, his wife, claims a jury found her husband guilty because a judge ruled important witness testimony inadmissible. According to Nancy, witnesses described the perpetrator as dark-skinned with long hair and in his 20s. Daly, meanwhile, was 42 at the time of the burglaries, is bald, stocky and short.
At an innocence hearing Wednesday, a judge considered the evidence originally dismissed with a keen focus on why the testimony was discarded in the first place. If the judge finds fault in the process of Daly's trial, he could receive a retrial.
