A federal judge ruled Tuesday a deaf Westbury student is not allowed to bring his service dog with him to school.
Fourteen-year-old John Cave and his family sued East Meadow School District for $150 million after administrators called police to stop Cave's dog, Simba, from entering Clarke High School. Cave and his family argue he is a disabled person who should be allowed to take his service dog to any public place. District lawyers argued Cave failed to exhaust all appeals with the school before suing. They add they're protecting the welfare of students and faculty who could be allergic to canines.
Cave's mother says the family intends to appeal the ruling, while district lawyers say they'll file a motion to dismiss the suit shortly.
