A Sea Cliff man who served time for murder was indicted Tuesday morning on charges including mail fraud, wire fraud and aggravated identity theft of his tenant.

Neighbors say Marilyn Mosberg-Shapiro, 76, lived in the basement apartment of John Derounian's home in Sea Cliff. According to the indictment, it was Derounian who called 911 last November to report he had found her dead in her apartment.

According to the indictment, on the day before Mosberg-Shaprio's death, a financial advisor was contacted on the phone by someone claiming to be Mosberg-Shapiro. The caller added Derounian, 51, as the authorized user on all of her bank accounts.

The week after she was found dead, officials say Derounian was seen at an ATM 19 times removing nearly $10,000 from Shapiro's account. Since then, officials say he had her cremated and emptied her estate - acquiring close to $1.2 million.

Derounian's attorney Brian Griffin says his client has pleaded not guilty.

"To be clear, he has not been charged with, nor is there any direct allegation, that he was involved with anyone's untimely death in connection with this case," says Greene.

Sources tell News 12 Derounian is being investigated in connection with the death.

Back in 1984, Derounian was convicted of murdering a Sea Cliff jeweler. He served 20 years in state prison and was released in 2007.
