DMV: Texting while stopped at red light is legal in New York

Despite a statewide ban on texting and driving, authorities say it's perfectly legal to send text messages while stopped at a red light.

Back in May, Gov. Andrew Cuomo rolled out stricter laws against texting while driving. But according to the DMV, the laws only apply when a car is in motion.

Driving instructor Sue Rosenberg says drivers have a false sense of security when they're sitting at red lights. She says texting, even then, is distracting and unsafe.

State Sen. Carl Marcellino sponsored a bill that would make it illegal to text at a red light or stop sign. It passed the state Senate, but didn't make it through the Assembly before lawmakers went on summer break.
