A judge today refused to grant a bail hearing to a man whose sex abuse conviction has been overturned.

Thomas Green, 66, was convicted in 2008 of molesting young girls in his Selden home. Two weeks ago, his conviction was thrown out by a federal judge due to faulty evidence. The judge ordered the district attorney to re-try the case.

Green's attorney tried to get his client freed on bond, but Suffolk County Judge Barbara Kahn disagreed, saying a federal judge has to set the bail.

Green has served five years of a 35-year sentence.
