A Suffolk County man is suing McDonald's, alleging he suffered second-degree burns from a coffee spill.

In a lawsuit filed in Suffolk County civil court on Wednesday, Gerard Salvia alleges that he suffered the burns after hot coffee spilled on him at a Melville McDonald's drive-thru in October. He claims he was handed a coffee with a loose lid, which popped off and led to the hot liquid spilling on him.

"Miss, my skin just peeled off," Salvia says to an employee in a video of the incident he took shortly after it happened.

Salvia's attorney, John Beatty, says his client went to the hospital and still has scars from the incident.

"It was the temperature of the coffee that caused this injury," Beatty said. "The consumer has nothing to do with that."

A request for comment from McDonald's was not returned.
