The Suffolk County Legislature decided Tuesday to appeal a court ruling that nullified its controversial worker status bill because of a perceived procedure technicality.
The bill, which passed in May, requires Suffolk County contractors to verify the legal status of their workers. Leg. Ricardo Montano (D-Central Islip) argued the bill was illegally brought to the floor and filed an injunction to prevent a vote from taking place.
In early June, a state Supreme Court judge ruled with Montano and the law remained in limbo. Now, the Legislature will appeal.
However, the legislators? vote did not create consensus. Montano argues Presiding Officer Leg. William Lindsay (D) had his injunction lifted without his consent and that the body broke its own rules. Lindsay says the legislature is free to interpret the rules as it sees fit.
The legislature will soon vote on a worker bill sponsored by Leg. Jon Cooper (D-Huntington) that puts the onus of verification on the federal government instead of the contractors.
