Driver indicted in crash that killed anti-gang activist Evelyn Rodriguez

A driver has been charged in the crash that killed Long Island anti-gang crusader Evelyn Rodriguez.
AnnMarie Drago is facing charges including criminally negligent homicide, criminal mischief and petit larceny. She was brought before a judge at the Suffolk County Courthouse in Central Islip Friday.
Rodriguez, of Brentwood, was hit and killed by an SUV in September. The incident happened on the two-year anniversary of her daughter Kayla's murder, allegedly by MS-13 gang members. Rodriguez was preparing for a vigil for her daughter and her friend Nissa Mickens.
A vigil was also held Friday night for Rodriguez.
Prosecutors say Drago attempted to destroy a vigil that was set up for the girls. They say that is when Rodriguez and her partner Freddy Cuevas showed up to confront Drago.
News 12 was at the scene for the confrontation, during which prosecutors say Drago hit the gas pedal in her vehicle and dragged Rodriguez. Rodriguez died at the scene.
"This is not a case where anyone was left wondering what happened. As a result of News 12 footage…we know what happened here," says Suffolk County District Attorney Tim Sini.
Prosecutors say Drago was in the process of selling a home for her mother adjacent to the memorial They say she stood to make $19,000 off the deal.
Drago was released without bail Friday. Sini says this was because she has no criminal record and has been cooperating with authorities.
Drago's attorney says his client apologizes for what they are calling a tragic accident.
Witnesses at the scene say the suspect's boyfriend helped destroy the memorial. At a planned community vigil Friday night, residents are expected to ask for charges to be filed against him as well.
Drago is scheduled to return to court Jan. 15.
