A St. James couple is suing the Diocese of Rockville Centre to stop a local church fair they describe as an annual four-day headache.
Richard Caldarola says the noise, traffic and trash from the annual carnival at Saints Philip and James Church is unbearable. The Caldarolas say they've tried to speak to the church, but had no luck.
?We have been trying for 30 years to get resolution on a number of issues here and we are at the point now where it has gone beyond anything we could have ever imagined,? Caldarola says.
The family is not only suing the diocese, but the church?s school as well. The diocese won't comment directly on the lawsuit, but says the carnival has tried to be a good neighbor and actually provides much-needed funds for the parish.
Diocese Spokesman Sean Dolan says the parish has tried to answer neighbors? complaints by moving the carnival to a different part of the property and is trying to solve noise, trash and parking concerns.
?I think we go above and beyond what's expected of us,? Dolan says.
The Caldarolas still say they want the matter in the hands of a judge.
