A Smithtown teen was sentenced to 30 days in jail Wednesday for a car crash that killed three people on Halloween night 2007.
Prosecutors say on the night of the crash, Steven Badke was driving over 80 mph down Jericho Turnpike in Smithtown when he hit a minivan heading in the opposite direction. His two passengers, Michael Western and Daniel DiStefano, both 17 years old, were killed. Thirteen-year-old John Aruano, who was riding in the minivan, later died as a result of his injuries
Steven Badke, 18, pled guilty to reckless driving, speeding, and failure to stay in the lane. Suffolk County District Attorney Thomas Spota originally charged him with criminally negligent homicide, but those charges were dismissed by the judge.
Janet Western, mother of Michael Western, says Badke got away with murder.?I want him to hear my son scream,? Western says. ?I want him to see my son?s lifeless body being dragged 300 feet stuck in his car.?
Badke must also pay a $900 fine. His license has been revoked until he turns 21.
