Prosecutors say the man accused of the deadly Deer Park nail salon crash had a blood alcohol content more than twice the legal limit at the time of the crash.
Prosecutors previously said 64-year-old Steve Schwally admitted to having 18 beers the night before the June crash.
Four people, including an NYPD officer and three Hawaii Nail and Spa employees, were killed.
Prosecutors plan to bring the case to a grand jury to consider upgraded vehicular homicide charges next week.
Schwally has pleaded not guilty to the DWI charge he is already facing.
