Some Long Island Rail Road commuters are getting their money back after they had their cars booted in the parking lot at the Broadway Mall.

The mall has been ordered to remove the boots by the town of Oyster Bay. Officials say private companies booting cars is in violation of town code.

The measure reads: "It shall be unlawful for any person to immobilize any motor vehicle parked in the unincorporated areas of the Town of Oyster Bay by any means, including but not limited to what is commonly referred to as booting."

The town says only police and municipal workers can boot cars in the town – even if it's on private property.

The town says more than 50 cars were booted in the past two days. It happened as the town gets ready to close its parking garage south of the Hicksville LIRR station for repairs. Some commuters say the mall was taking advantage of the parking crunch.

"What has happened here is a clear case of abuse to our residents. This is wrong,” said Oyster Bay Town Supervisor Joseph Saladino. “…We ask anyone who has been fined…to contact the Broadway Mall for a refund – and if they don't get it, call my office and they'll hear from me."

News 12 was on site this morning when a tow-truck operator removed boots from vehicles around the lot.

Saladino says the mall and towing company have also been ordered to take down towing enforcement signs in the parking lot, because the towing charge on the signs is incorrect.

Town code says the charge is not more than $95 for towing. The towing company is charging $225, more than twice the legal amount.

Mall management did not return News 12’s calls for comment.

The town says parking for residents with town parking permits will be available in the Sears parking lot across from Broadway Commons. From there, commuters can use a shuttle service to the LIRR station.
