A mother whose son fell four stories from her East Tremont window will not face charges, police confirmed Wednesday.

Authorities described the incident as a "tragic accident." However, neighbors told News 12 The Bronx the mother may have been sleeping or doing laundry when the 3-year-old climbed out a window at their Clay Avenue and 176th Street apartment Tuesday.

Neighbor Tito Gonzalez said the boy, who was often seen playing outside his home, was unconscious on the sidewalk and bleeding from his nose. He said someone rushed to get the mother, who then collapsed next to her son.

A makeshift memorial now sits at the site where the child fell. He was rushed to St. Barnabas Hospital in critical condition and later transported to New York Presbyterian.

"I feel so bad because the dad is a nice guy," said Pedro Rivera. "Loves his kid, works hard to support his family."

While window guards are required on most apartment windows, they are not required for those with fire escapes. Some believe the guards may have prevented the tragedy.
