(09/28/06) HICKSVILLE - A man, who was having a stroke, says he was wrongly arrested for driving drunk and is suing Nassau County.
Jorge Aguilera, 62, was driving on the Long Island Expressway in August of 2004 when he was pulled over by Nassau County police for driving erratically. Aguilera says he told the officer he was not feeling well and could not control his movements. Police administered a Breathalyzer test, which Aguilera says he passed, and arrested him for driving while intoxicated. After two hours of being chained to the floor of police headquarters, doctors concluded Aguilera was not drunk, but was having a stroke.
The Sands Point limousine driver is suing the county in federal court for false imprisonment and violating his civil rights. Nassau police say the plaintiff did fail the field sobriety test and they have not disciplined the arresting officers to date. A judge denied a county motion Thursday to dismiss the case.
