Nassau District Attorney Kathleen Rice is coming under fire from leaders of her own Democratic party for her handling of an investigation that led to the ousting of Nassau Police Commissioner Thomas Dale.

Nassau Democratic Party Chairman Jay Jacobs sent an 11-page letter to Rice asking why she has not filed criminal charges of witness intimidation or election law violations against Dale and others involved in the campaigns of County Executive Edward Mangano and former Freeport Mayor Andrew Hardwick.

Dale resigned last week after an investigation into alleged witness intimidation by Rice. The Nassau D.A.'s probe found Dale personally directed his officers to arrest Randy White, a key witness in an election fraud case connected to the county executive race.

Rice released a letter that said Dale's actions raised some troubling questions, but found no criminality. Jacobs scoffed at Rice's conclusion.

Jacobs says he and other Democratic leaders will ask the governor to appoint a special prosecutor, or contact the attorney general about taking over the case.
