Lynbrook woman claims wrongful arrest in planned lawsuit

<p>A Lynbrook woman says she is planning to sue the Lynbrook Police Department and the Nassau District Attorney&rsquo;s Office, claiming that she spent 30 days in jail for a crime she did not commit.</p>

A Lynbrook woman says she is planning to sue the Lynbrook Police Department and the Nassau District Attorney’s Office, claiming that she spent 30 days in jail for a crime she did not commit.
Andrea Allen says court records show she was facing a judge for assault and menacing charges on Dec. 16, the same day Allen says her neighbor accused her of vandalizing a car.
Allen says she was arrested on Dec. 17 and charged with criminal mischief for the alleged vandalism.
"I knew that at that time and that day I was in court and that's what I told them,” says Allen. She is suing authorities for not investigating her alibi.
Rev. Kevin McCall, of the National Action Network, says the “Lynbrook Police Department did not investigate this fully. The district attorney’s office prosecuted this case with a lack evidence.”
A spokesman for the Nassau County District Attorney's Office says, "The law precludes us from commenting on sealed cases."
News 12 also reached out to the Lynbrook Police Department, but was told no one was available to answer questions.
