Jakwan Keller was in court yesterday in Hempstead.
Keller's lawyer tells News 12 when he was arrested he told police "You have arrested me but don't stop investigation, I didn't do it."
Police say Keller fired shots at 12-year-old Dejah's home as gang retaliation after his brother's hover board was stolen.
Defense attorneys want Keller released if he's not indicted by tomorrow.
Prosecutors say the case will be present to a grand jury.
