(10/12/06) MINEOLA ? Victims? families in the Meadowbrook Parkway DWI murder trial were hopeful Thursday as the deliberating jury members asked to rehear key testimony.
The jury began deliberations Wednesday afternoon. Thursday, they asked to be reread the testimony of two police officers who spoke with suspect Martin Heidgen shortly after the July 2005 crash. Heidgen is charged with the murder of limo driver Stanley Rabinowitz and 7-year-old flower girl Katie Flynn. Prosecutors have sought a murder conviction because they say Heidgen showed depraved indifference to human life when he allegedly drove intoxicated on the wrong side of the Meadowbrook Parkway. Flynn?s father says the jury?s move to rehear that testimony shows they are focusing on Heidgen?s mindset, the cornerstone of the murder charge.
If the jury finds Heidgen not guilty of murder, they may still convict him of manslaughter or criminal negligence. The latter charges carry much lighter sentences than murder.
