A judge's ruling Friday may give a convicted Levittown robber another chance to prove his innocence.
John Daly's wife has been fighting for his release since he was sentenced to 25 years in prison nearly six years ago. Imprisoned for the armed robberies of a Mobil station and an OTB parlor in Farmingdale, Daly's wife used the freedom of information act to uncover witness testimony describing the robber. She says witnesses describe a young, thin man with long hair. Daly is in his 40s, stocky and bald.
In his ruling, a judge recommended a four-judge appellate panel review the case. The move does not guarantee a new trial, but Daly's family is thrilled with what they consider an encouraging step. The appellate process will probably not begin for at least six months.
