Charges will stand against the driver accused of running over and killing anti-gang activist Evelyn Rodriguez.
A judge ruled Monday that Annmarie Drago, of Patchogue, will face criminally negligent homicide charges, according to Newsday.
Drago is accused of throwing out a memorial to Rodriguez' daughter on the second anniversary of her daughter's death at the hands of MS-13.
When Rodriguez confronted Drago in her car, Drago is accused of hitting the gas, killing the Brentwood mom last September.
Drago's attorney says his client felt she was "in danger."
