The father of Jordan Neely has filed a lawsuit against Long Island native Daniel Penny amid the ongoing manslaughter trial.

Andre Zachary’s lawsuit accuses the Marine veteran from West Islip of negligence as well as assault and battery.

Penny put Neely in a chokehold on a subway in May of 2023. His lawyers say he did it to save other passengers because Neely was verbally threatening and moving towards them.

Prosecutors say Penny used too much force. Jury deliberations in the trial entered its fourth day on Friday.
