John Gotti's grandson seeks another delay in prison surrender as kidney transplant postponed

John Gotti's grandson is asking a federal judge for another delay in his prison surrender after a kidney transplant planned for his mother was postponed due to a serious infection.

Carmine Agnello, who was sentenced to 15 months in prison for stealing more than $1 million in COVID-19 relief funds, had hoped to donate a kidney to his mother, Victoria Gotti, before reporting to prison.

The transplant was scheduled for Monday, but Agnello's attorney, Robert V. Beltrani, said in a court filing Tuesday that Victoria Gotti was tested last week in preparation for the surgery and doctors found she has a serious infection requiring "a battery of antibiotics."

The letter says Agnello "simply awaits word of a green light for surgery," and has "high hopes" to donate his kidney before the Aug. 10 self-surrender date. His lawyer is asking the court to consider a self-surrender date of Sept. 18 if the surgery takes place before then.

The request comes after a judge previously denied Agnello's bid to avoid his sentence entirely for the organ donation.

He is currently scheduled to surrender to the Bureau of Prisons on Aug. 10 unless the court grants the latest request.
