A dune building project continues in Montauk this morning without a pending lawsuit. 
As News 12 reported, the group "Defend H20" was suing the Army Corps of Engineers, saying a dune project would damage the beach.
Yesterday, the group dropped its suit after a judge denied a request for an injunction.
The project is already underway, and its goal is to build a sandbag seawall to prevent downtown Montauk from flooding.
