A Westbury woman is facing a DWI charge after allegedly being found slumped in the driver's seat of her running car while her 3-year-old was in the backseat.
Nassau police say they found Danielle Kalberer, 34, with her car partially up on the curb on Hillside Avenue in Williston Park at around 5 p.m. Monday.
During her arraignment in Hempstead District Court Tuesday morning, she admitted to having taken heroin and cocaine despite being in rehab.
Kalberer's lawyer Anthony Colleluori says a series of events ultimately led to the incident, including her father having lung cancer and her child being born with spinal bifida. He also says there might have been post-partum depression that was never addressed.
Kalberer's 3-year-old is staying with a grandparent. News 12 was told her husband is also in rehab, scheduled to leave by the end of the week. Her defense attorney says he's working to get Kalberer supervised visitation with her daughter while she's out on bond.
