Garcia’s attorney, Fred Brewington, says he will begin preparing for a second trial.
On the witness stand, Garcia said he felt terrified and violated, and said he had no control. He also said he felt profiled because of his race.
According to Brewington, Suffolk police failed to document the incident.
“There was no record of this stop. No record of this search and these officers just assumed no one would question them, but Brian Garcia did,” Brewington added.
A date for the second trial has not yet been set.
