Charges against a Baldwin PTA mom allegedly found half-naked in a car with a 13-year-old boy last year were upgraded Wednesday after prosecutors introduced new evidence.
Police say 44-year-old Joan Tuckruskye and the boy admitted to kissing when they were caught in a school parking lot in December. However, prosecutors say they have DNA evidence that shows the two engaged in oral sex. Defense attorney Brian Griffin says he?s hiring a DNA expert, but says the test done doesn't prove anything.
"There's a difference between a match and something being consistent. This is not a straight on match,? Griffin says. ?At the very best it's inconclusive."
The Baldwin mom was initially charged with misdemeanor endangering the welfare of a child, but now faces felony charges for sexual abuse and engaging in a criminal sexual act.
Tuckruskye?s husband tells News 12 Long Island it has been a very difficult time for his family and that he and his daughter are trying to move on. The teen?s uncle says an upgraded charge is exactly what the family has been waiting for.
