Charges could be upgraded against the Auto Zone driver accused of hitting and killing a pedestrian in North Babylon.
The delivery driver pleaded not guilty in court Wednesday after being accused of running down two pedestrians in North Babylon.
Donnell Hicks, 26, of Queens, faced a judge in Central Islip and was arraigned on the charge of leaving the scene of an accident resulting in death.
Prosecutors say Hicks was backing out of the parking lot of Auto Zone on July 29 when he hit two people, 40-year-old Eric Krems and 38-year-old Ann Marie Christina, of East Quogue.
The assistant district attorney says Hicks did not stop and kept driving while Christina was caught in the wheel well of his truck. They say he dragged her until he made a turn onto Shade Street.
Prosecutors say motorists were honking their horns, and Christina was screaming until he stopped. They say that's when Christina's body became dislodged from the wheel.
Hicks' attorney says it was an accident.
According to District Attorney Tim Sini, Hicks got out of the truck and saw her, then got back in his truck and took off. A memorial now stands where the car was stopped.
Christina was pronounced dead at the hospital. Krems was treated and released.
Hicks' defense attorney says his client has deep remorse for what happened, but claims it was simply an accident.
Christina's family is calling for justice. Hicks is due back in court Sept. 10.
Sini says the hit-and-run is still an active investigation and that prosecutors may seek additional charges.
