An accused drunken driver had his charges upgraded Thursday for a crash that killed his passenger in Deer Park.
Stephan Harbison, of Coram, was arraigned on new felony grand jury charges. Prosecutors say Harbison's blood-alcohol level was almost twice the legal limit when he slammed into a tree on Straight Path in January.
Passenger Hamzah Abdul-Hakim, of Wyandanch, died in the crash. Another passenger, Ismail Latif, was ejected from the vehicle. Latif sustained a traumatic brain injury, but has since been released from the hospital.
The grand jury additionally charged Harbison with insurance fraud and perjury, as well as vehicular assault, vehicular manslaughter, and DWI. He was not able to post $400,000 after pleading not guilty.
Harbison is being held at the Suffolk County Jail in Riverhead.
He is due back in court later this month.
