One of Nassau County?s top brass is on the wrong side of the law for allegedly driving drunk.The Nassau County DA?s Office says 57-year-old Vincent Muscarnera plowed an unmarked car into a phone pole on the Jericho Turnpike in Westbury July 11. The 36-year police veteran was off-duty and had just left a fellow officer?s retirement party in Williston Park. The DA says he had to get a warrant to test the senior officer?s blood alcohol content level and found it to be three times the legal limit.

Muscarnera is suspended without pay during the investigation. His attorney says the officer will fight the case.
