NYCLU files suit against Suffolk sheriff’s office for detention of immigrants
The New York Civil Liberties Union filed a lawsuit against the Suffolk County Sheriff's Office, claiming it’s breaking New York state law by detaining undocumented immigrants in Suffolk jails until they can be picked up by ICE.
The case centers around a Suffolk man who came to the United States illegally from India two decades ago. He's currently being held in jail in Riverhead, even though his criminal court case was settled.
“Our client pled to time served on a disorderly conduct violation. He would have been free to go if there wasn't a detainer on him. He should have been able to walk out of court. Instead, he was sent back to the Riverhead jail, and he's being held there for ICE to eventually come and pick him up,” says NYCLU attorney Jordan Wells.
The Suffolk Sheriff’s Office says it honors ICE warrants because it is following the advice of the Suffolk county attorney.
Suffolk County Executive Steve Bellone's office declined to comment
