Legal action is being taken in one school district over Nassau's decision to postpone fall sports.
News 12 has learned the Massapequa School District is suing to overturn that decision.
The lawsuit claims the regional athletic board overstepped its authority by delaying play until the winter due to the pandemic.
The lawsuit goes on the say the postponement harms the "mental, emotional and physical well-being of the athletes."
The choice was made days after Gov. Andrew Cuomo gave districts the go-ahead to play low and moderate risk sports. But Section VIII of the New York State Public High School Athletic Association squashed the decision - pushing the start of all sports from Sept. 21 to January 2021.
Jeanine Caramore, vice president of the Massapequa Board of Education, says according to Section VIII's constitution, a decision of that size should have required a vote from all districts. She says five superintendents made a "hasty decision."
The suit comes as Suffolk County also decided to push sports back until next year.
