A Port Jefferson Station man was indicted on murder, manslaughter and assault charges Tuesday for allegedly shaking his girlfriend?s child to death last month.
Prosecutors say Howard Brooks shook 11-week-old Madeline Mendolia, causing her skull to fracture and sub-dermal retinal hemorrhages. On March 29, the child?s mother Sareena found the baby unresponsive in her Middle Island home. She told police Brooks was alone with the child moments earlier. The baby died two days later.
Prosecutors also say they have a videotaped confession from Brooks. They say he has a history of mental illness and admitted anger management problems. Brooks? attorney Eric Naiburg, however, says his client does not have an issue with anger.
The defense also points to the coroner?s report, which found the baby had two old rib fractures and evidence of other serious injuries. They say those injuries could have been inflicted by someone else.
?Of course he didn't live with the child,? Naiburg says. ?So who caused those injuries? We're not quite sure.?
Brooks is being held without bond and is due back in court April 29 for a bail reduction hearing.
