A Medford father is facing charges after police say he left his 13-month old son at home alone.

Police say they received a call on Sunday afternoon about a baby crying in the apartment of a home on Little Treasure Drive in Medford.

Nicole Villarente and her boyfriend say they saw their downstairs neighbor leave the home at around 1:15 p.m. About 20 minutes later, they heard the infant's cries, and realizing that the baby was likely in the apartment alone, they called Suffolk police.

"They tried to pry the door open, but they couldn't, so they kicked the door in and we found the baby in his crib in a wet diaper," Villarente says.

The child's father, Kelly Voss, arrived home about 40 minutes after police responded to the scene. Voss was arrested.

Suffolk police took the baby, named Liam, to the Sixth Precinct, where he was picked up by his mother.

When asked in court today where he went when he left the child alone, Voss declined to comment. Prosecutors say he gave a sworn statement to police saying that he ducked out to buy a pack of cigarettes and wasn't gone for more than 40 minutes. However, his neighbors claim that he was gone for slightly longer.

Voss was issued an order of protection and was told to stay away from his son. He was released today on his own recognizance and is due back in court on Dec. 9.
