A Long Island couple fighting over a donated kidney appeared in court for paperwork and legal proceedings Tuesday.Dr. Richard Batista, of Ronkonkoma, is suing his wife, Dawnell Batista, to get his kidney back. He says he donated the kidney to her when she was ill in 2001 and then later learned she was having an affair.Her attorneys deny that she was unfaithful and say her husband is the reason the marriage went sour. Dawnell Batista says her husband was convinced that she was having an affair and would examine her underwear to try to find evidence to back up his claim.Dr. Batista says there is no value that one could put on a body part if it saves someone's life. His attorney, Dominic Barbara, says if she can't return the kidney, his client wants $1.5 million.
Dawnell Batista?s lawyer and the law guardian for the couple?s children are asking for a gag order, claiming the media frenzy surrounding the case is bad for the children. No decision has been reached yet. Both sides have said the trial probably won't begin until the end of February or beginning of March.
