A Kings Point family is suing the village, claiming village officials would not issue summons for their neighbor’s construction projects that allegedly violate the village code.
The Noghreh family says mudslides and flooding have become the norm since their new neighbor bought the property last year.
They allege the neighbor is doing construction projects that violate village code, like sloping their property and cutting down trees without a permit. The family also says the addition to the neighbor’s home is also too close to their home by at least 3 feet.
The family says back in July, they came home after burying a family member to see several trees cut down and their internet cable cut, which powered a security camera facing where the construction is taking place.
The family is now filing a federal lawsuit claiming the village is refusing to issue a summons because a village employee is listed as one of the new homeowners. They also claim the village refuses to meet with them to discuss the problem.
Mojdeh Noghreh says because the village hasn’t issued a stop work order for the construction projects, she’s worried what damage the next rain storm will do to her home.
"We wanted this to be resolved amicably but nobody wants to speak to us,” she said. “I cannot go on like this. One more rain, my house is ruined. My property is ruined."
Noghreh says before the projects began, they never got any flooding at their home, not even during Superstorm Sandy.
An attorney for the village says they will not comment on pending litigation.
