(09/21/07) MINEOLA ? The man convicted of killing a Lynbrook father was once again hit with the maximum sentence for the crime Friday.
Nelson Zuniga, 23, was convicted of killing Anthony Battaglia as he was walking home from the train station in 2003.
Zuniga was sentenced to 70 years to life for the crime two years ago. However, a state appellate court ruled that the judge in case acted improperly during the trial. Before the trial, the judge told Zuniga he would get consecutive sentences for murder and robbery if he insisted on going to trial and lost.
The initial sentence was tossed. However, a second judge ruled Friday that Zuniga did in fact deserve the maximum sentence of 70 years to life.
Battaglia?s wife addressed reporters after the second sentencing. She said any sentence that keeps Zuniga off the streets has to be carried out.
