(09/20/06) MINEOLA - The judge presiding over the Meadowbrook Parkway DWI murder trial deemed vials of blood inadmissible as evidence Wednesday.
Martin Heidgen, who is charged with murdering two while allegedly driving drunk the wrong way on the Meadowbrook Parkway in July of 2005, and his attorney scored a major victory early in the day when two vials of blood were thrown out as evidence. The prosecutors say the blood samples prove Heidgen was intoxicated the night of the collision, while defense attorneys maintain that state troopers mishandled the blood. Stephen LaMagna, Heidgen?s lawyer, claims that the samples in question do not even belong to his client.
The judge also granted the prosecutors? request to take a DNA sample from Heidgen and compare it to the controversial vials. Relatives of Katie Flynn, a 7-year-old victim of the accident, say they hope a DNA match will convince the judge to readmit that crucial piece of evidence. Stanley Rabinowitz, the limo driver, was also killed in the crash.
