A Holbrook man convicted of driving drunk and killing a Boy Scout will not get a new trial.
A judge denied Thomas Murphy's appeal on Tuesday.
Murphy is serving time in prison for killing 12-year-old Andrew McMorris.
McMorris was walking with his Boy Scout troop in 2018 when prosecutors say Murphy drove into them.
Murphy was convicted of aggravated vehicular homicide and other charges.
His legal team tried to argue the trial was biased.
