Police say 45-year-old Gary Hendricks was drunk when he rear-ended a truck and flipped several times. Hendricks' grandfather Isaac Beal was killed in the crash, and another passenger was severely injured.

Prosecutors say Hendricks was driving with a suspended license.

A judge says he has nine prior convictions and six failures to appear in court in New York and South Carolina.

Hendricks' brother says his brother has a drinking problem and needs help.

Meanwhile, Hendricks is being held on $100,000 bail and will appear before a grand jury tomorrow at 3 p.m.
